What Did Marx Mean When He Talked About Exploitation and Surplus Value?

Marx argued that the expropriation of surplus value by capitalists is the main source of the oppression and exploitation of the members of the working class. What is surplus value, how is it expropriated, and why is this expropriation exploitative? Capitalists are the owners of the forces of production (machines, soil, buildings, infrastructure, etc.). This exclusive ownership implies the monopolization of the means of labor, and this implies the monopolization of the sources of life.

A monopoly like this doesn’t merely create dependence and therefore precarity for workers; it also means exploitation. Workers are exploited because the surplus value — a worker creates more value in a day than he gets paid — is taken by the capitalist. Or, in other words: the wages of the laborer have a smaller exchange value than the exchange value of the object he or she produces. The object is sold by the capitalist, who buys labor and pockets the difference. A typical worker produces values that exceeds the reimbursement of their labor. A worker works more than the hours necessary to embody in his product the value of his labor power.

For example, if the value of labor power, i.e., the wage, is $50 a day, and a worker produces a good (or goods) which is worth $100 during a full day of work, then the second half of the day would yield surplus value, in this case another $50.

The expropriation of this surplus value is theft, because the capitalist takes something which he has not produced. He or she takes the unpaid labor and products of someone else and lives on the back of someone else, simply because of the privilege of owning the means of production. The workers have to accept this because they depend on the capitalist. They have to sell their labor power in order to survive because they do not own means of production and hence can’t produce and live without the consent of the capitalists. As the workers’ energy is not depleted after their own reproduction is guaranteed — through the payment of a wage — one can use it to produce more.

Moreover, the capitalist continuously tries to maximize this surplus value. There are two means to achieve this maximization. First, technology and science increase productivity and diminish the necessary labor time per unit of production. Machines make it possible to produce more with less labor. If wages stay constant and productivity goes up, then surplus value goes up.

But wages, of course, do not stay constant. The capitalist also tries to make labor as cheap as possible and the working day as long as possible. This is another kind of oppression, different from but inextricably linked to the expropriation of surplus value. This is achieved by way of the so-called “industrial reserve army”. This is a relatively large group, constantly available but not necessarily made up of the same people. They are perhaps unemployed, or working for peanuts in the developing world, or perhaps they are children. And they are desperate for (better paid) work, ready to replace the (elsewhere) employed and ready to accept a lower wage and a longer working day. This reserve army is a millstone round the neck of the proletariat, a regulator keeping wages at a low level.

The capitalist accumulates surplus value and wealth, and the worker accumulates misery. This “immiserization” (“Verelendung”) of the proletariat is something relative: it’s the gap in resources between those who own the means of production and those who don’t that will widen.

This maximization of surplus value deepens social divisions, brings despair to the workers, and hence will ultimately contribute to the collapse of capitalism, or so Marx believed.

Marx and the Arrows of Determination

How do the different parts of the substructure and superstructure determine each other according to Marx?

Marx is usually understood as arguing that the substructure (the material world) determines the superstructure. But that’s only part of his argument. The creation and propagation of ideology is an important activity of the ruling class. The members of this class usually do not work but appropriate the fruits of the labor of other classes, and hence they have the necessary leisure time to engage in intellectual “work” and to construct and promote ideologies that they can use to serve their interests, consciously or unconsciously. Those with material power also have intellectual power. They can influence what others think, and they will be most successful if they themselves believe the ideologies that they want to force on others.

This clearly shows that the substructure does not only determine the legal and political parts of the superstructure, but thinking as well. The prevailing ideas are the ideas of the prevailing class.

[T]he class which is the ruling material force of society, is at the same time its ruling intellectual force. The class which has the means of material production at its disposal, has control at the same time over the means of mental production, so that thereby, generally speaking, the ideas of those who lack the means of mental production are subject to it. The ruling ideas are nothing more than the ideal expression of the dominant material relationships, the dominant material relationships grasped as ideas; hence of the relationships which make the one class the ruling one, therefore, the ideas of its dominance. The individuals composing the ruling class possess among other things consciousness, and therefore think. Insofar, therefore, as they rule as a class and determine the extent and compass of an epoch, it is self-evident that they do this in its whole range, hence among other things rule also as thinkers, as producers of ideas, and regulate the production and distribution of the ideas of their age: thus their ideas are the ruling ideas of the epoch. But there is a kind of feedback action at work here. The substructure determines ideas, but these ideas in turn help to maintain a particular economic substructure. Not everything goes up from the material to the intellectual. Something comes down as well, but only after it went up first.

This can be expressed in the left half of the following drawing:

In this drawing, an arrow means “determination”. All ideas, not only political and legal ones, are both the expression (arrow 2) and the safeguard (arrow 3) of the economic structure of society. (The bottom-left half, arrow 1, represents the previously mentioned relationship between means of production and relations of production).

But there is also a right half in this drawing: the fact that ideas, in a kind of feedback mode, help to determine a particular economic structure, does not always have to be negative or aimed at the status quo. The poor, when they shed their false consciousness imposed by ideology, become conscious of their real situation, and this consciousness will help to start the revolution which will modify class relations and hence the substructure. This is represented by arrow 6.

Ideally, arrow 6 would have to pass through the box containing “politics” since the revolutionary proletariat will take over the state when attempting to modify the relations of production.

However, this awakening is bound to certain material preconditions, in particular the presence of certain very specific forces of production, namely large-scale industrial production with mass labor (arrow 4) and the strain imposed by existing class relations (arrow 5). It cannot, therefore, take place in every setting. Ultimately, all consciousness, real and false, is determined by the substructure. The order of determinations is fixed and follows the numerical order in the drawing.

The Ethics of Human Rights (84): Aggregation Across Persons

Is aggregation across persons – making a decision that some people should bear losses so that others might gain more – ever permissible?

On the one hand, studies have shown that people faced with trolley problems would often sacrifice one person in order to save several others. Ticking bomb arguments – in which a single terrorist is tortured so that millions can be saved from an impending explosion – can also count on the agreement of large majorities.

On the other hand, an exchange like this one leaves most of us shocked:

Ignatieff: What that comes down to is saying that had the radiant tomorrow actually been created [in the USSR], the loss of fifteen, twenty million people might have been justified?
Hobsbawm: Yes.

The thinking in both cases is plainly utilitarian – that it’s acceptable to trade off the lives of some so that others can benefit. And yet our reactions to the two cases are polar opposites.

What can account for this difference? In the former examples, the good is more obvious, namely the saving of lives. The good that could – perhaps – have come from communist tyranny is rather more vague, more uncertain and less immediate. Trolley problems and the ticking time bomb scenario also present a balance between the good and the harm that supposedly needs to be done in order to achieve the good that is more clearly in favor of the good: it’s typically just one person that has to be sacrificed or tortured, not millions as in the case of communism.

So there’s a clear, immediate and widespread good that is supposed to come from the trolley sacrifice and the ticking time bomb torture (I say “supposed” because the hypotheticals don’t tend to occur in reality), and the harm that needs to be done to achieve the good is limited. This suggests that we favor threshold deontology: things which we normally aren’t supposed to do are allowed when the consequences of doing it are overwhelmingly good (or the consequences of not doing it are overwhelmingly bad). This theory is different from plain Hobsbawmian utilitarianism in the sense that it’s not a simple aggregation of good and bad across persons resulting in a choice for the best balance, no matter how small the margin of the good relative to the bad. A crude utilitarianism such as this does not agree with most people’s moral intuitions. Neither does dogmatic deontologism which imposes rules that have to be respected no matter the consequences.

However, threshold deontology creates its own problems, not the least of which are the determination of the exact threshold level and the Sorites paradox (suppose you have a heap of sand from which you individually remove grains: when is it no longer a heap, assuming that removing a single grain never turns a heap into a non-heap?).

The moral problems described here are relevant to the topic of this blog because the harm or the good that needs to be balanced is often a harm done to or a good done for human rights.

The Ethics of Human Rights (79): A Right to Do X ≠ X is the Right Thing to Do

I’ve argued before that human rights and morality are at best two partially overlapping domains. Many human rights imply a right to do wrong: free speech includes the right to insult and to break promises, two things which most reasonable accounts of morality would consider wrong. A lot of what is prohibited by morality is protected by human rights. Most would consider systematic lying – as opposed to lies of convenience – a breach of elementary moral rules, and yet the liar is protected by his or her free speech rights.

The other side of the coin: zealous pursuits of moral goals – even universally accepted moral goals such as justice and fairness – often lead to violations, sometimes gross violations of human rights. Think communism. Strong convictions about good and evil can lead to violent coercion of others who don’t conform to these convictions. FGM is another example: one of the reasons why people engage in female genital mutilation is the fear that if women are left unmolested they won’t be able to restrain their sexuality and will likely act immorally.

People often think as follows: given that they are convinced that X is the right thing to do (morally speaking) they conclude that they have a right to force others to do X. Needless to say that this conclusion is not acceptable. Life would be a hell of permanent coercion if it were.

However, it’s not impossible to imagine cases in which the morally right thing to do should be done even if it leads to rights violations: the ticking time bomb case comes to mind.

Of course, rights and morality do overlap in a lot of cases: murder is morally wrong, and there is a right to life that should be respected. I could cite literally hundreds of examples. Many things are morally wrong and at the same time violations of rights. If you have a right to do something, often you’ll also do the right thing; or better: if someone has a right to do X or a right to X, then others will be forced to do the right thing, which means acting in ways that respect that X.

What is Totalitarianism?

It sounds like a somewhat antiquated concept and it may very well be true that it’s useless as a descriptive device for current politics. However, I believe that it remains a necessary tool for the correct understanding of 20th century history. Nazi Germany, Soviet Russia and Mao-era China were very different countries and very different political regimes, but it can be argued that what they had in common was more important than what separated them. And what they had in common separated them from all other authoritarian governments before and after them. (Hannah Arendt was one of the first to notice this). That is the reasoning behind the concept of totalitarian government. Those three governments – and perhaps a few others – can be described as totalitarian states and were therefore instances of a separate type of government, like oligarchy or democracy. They were not just particularly brutal forms of dictatorship. We’re not talking about a difference in degree. Of course, some of the elements of totalitarian rule which I describe below can be found in other dictatorial governments as well, but other elements can’t. (Just like some elements of democracy can be found in non-democracies). And what certainly can’t be found elsewhere is the combination of all those elements.

Totalitarian government is a post-democratic form of government. It couldn’t exist in the era before mass democracy. It’s post-democratic in the sense that it is an outgrowth of modern democratic traditions. Political parties, party ideologies, mass movements and mass mobilization, the pseudo-popular legitimacy of rigged elections and referenda, the mass idolatry, the personality cults, mass indoctrination, propaganda, Potemkin constitutions, show trials etc. all show the totalitarian debt to democracy. The same is true for the focus on re-education and rectification of thought when some parts of the popular will are considered to be deviant: this is proof of the importance of popular consent (when consent is absent, it’s fabricated).

Contrary to older forms of despotism, totalitarianism admits that the state is no longer the natural property of a ruling class, the private tool of a sovereign or a gift of God. It is the expression of the will of the people. Not, as in a democracy, of a divided people or of a people who’s identity fluctuates over time as a consequence of public debate. The will of the people under totalitarian government is permanently defined as a unified whole. The people are defined as a race or a class. The people have a homogeneous project, namely racial supremacy or the liberation of the proletariat. The will of the people, which is also the basis of democracy but which is always kept vague, heterogeneous and fluctuating in a democracy, now becomes a singular, clear and permanent will. All individuals and individual projects or interests are identified with a collective project. Everything which is in accord with this project, is part of the people; everything else is not – is foreign, alien, “entartet”, bourgeois or capitalist – and must be destroyed. If it’s the whole of the people that works towards a certain project, then those with another opinion are enemies of the people and have to be destroyed to protect the people and its project.

That is the origin of the genocidal nature of all totalitarian governments but also of their less extreme forms of exclusion of the other. Every internal division is seen as external. The other is not part of the people. Society isn’t divided but is divided from its enemies. Every sign of internal division is externalized: dissidents are foreign spies, the other is a member of the international jewish conspiracy, a tool of international capitalism, the fifth column etc. For example, long after it was clear that the attack on Hitler in 1939 was the work of a single German individual (Georg Elser) the nazis maintained that the British secret service was to blame. The other attack by von Stauffenberg in 1944 was framed as the work of aristocratic officers who were alienated from the German people. This division between internal and external is consciously cultivated because it confirms the image of the people as a unified whole. If real foreign spies or class enemies can’t be found then they are created. and duly suppressed. Hence everyone can become the enemy, even the most loyal followers.

The fixed will of the people is subsequently represented by the party and the state. The party doesn’t represent a majority, but the people. Hence, other parties have no reason to exist. All people and the whole of the people are represented by a single party. And since this party perfectly represents a perfectly clear and unified popular will, it can infiltrate all parts of society: school, church, labor union, factory, the press, the judiciary, the arts and all other social organizations cease to be independent. The party is everywhere and submits every organization to its will. It believes it can do so because its will is the will of the people. And the party uses the means of the state to be everywhere: the secret service, the department of communications, the police… As a result, the state is also everywhere. Totalitarian government simultaneously bans people to the private sphere – all free and deviant public actions and expressions are forbidden – and destroys the private sphere, to the point that people can’t even trust their friends and family. All private actions are potentially public. Wiretapping, surveillance, public confessions… Even the most private things of all, your own thoughts, are attacked by way of propaganda and indoctrination. Totalitarianism strives for total control of private and public life. All spontaneous and independent individual or social projects are doomed unless they are completely trivial. They can only survive when they are part of the common project, because they make sense only when they are part. When they are not, they are potentially in opposition to the common project.

But we should understand that the identification of the party with the state is only temporary. The state in fact is bound to disappear. That becomes clear when we consider the imperialism that is typical of totalitarianism (to a lesser degree in the case of China). By definition, the projects of totalitarian governments – racial supremacy or a classless society – go beyond the borders of a state. Aryans aren’t only meant to rule within the borders of Germany. They deserve global supremacy in part because they are the best race and in part because the Jews are a worldwide threat. And the classless society can’t exist when it is surrounded by a capitalist world; the proletariat in other countries also deserves to rule.

Totalitarianism is a form of rule that goes beyond the state. A particular state is just a convenient tool for a certain stage in the popular project. The people as well is a concept that goes beyond the group of citizens of a given state. There are also Aryans and workers in other states. In non-totalitarian dictatorships, political rule is essentially tied to the state. A normal dictator may attack other countries, but will do so while enhancing his state or expanding his country. His rule will never go beyond the rule of a state, suitably redefined if necessary. If necessary he’ll redraw the boundaries of the state, but he will never go beyond the state as such. Totalitarian rule, on the other hand, is ultimately larger than the state. It’s the rule of a race or a class, on a potentially global level.

As the people and the state are subject to the rule of the party, so the party is subject to the rule of one individual. The leader makes sure that the party remains unified, because a divided party can’t claim to represent a unified people. So there’s a series of identifications going on: the people is identified with a class or a race; this unified people is then identified with the party that represents it; the party in turn identifies itself with the state because it (temporarily) needs the tools of the state to realize its project (class rule or race rule); the state then takes over society and identifies with it; and ultimately a single leader takes over everything in order to guarantee unity.

The people are like a collective individual, a body with a head controlling all its coordinated movements. State terror and genocide can then be seen as the body removing sickness and parasites. The other is often explicitly identified as parasitical or infectious. Violence and oppression are medicines used to safeguard the integrity of the body of the people and their purpose. The Great Purge wasn’t called a purge by accident. The Jews weren’t depicted as pestilent rats for no reason.

The image of the body also means prophylaxis: why wait with punishment until the crime is committed? We know that certain persons are enemies of the people. Crime in the sense of opposition to the project of the people is a fatality for them, sooner or later. There may be good Jews, but we can’t take the risk that they marry an Aryan and defile the race. And some capitalists may be less harmful than others, but why wait until their presence undermines collectivization or until they betray the country and invite an invasion?

Totalitarian government isn’t like a normal lawless and arbitrary dictatorship. Of course, the laws under totalitarian government are regularly broken or changed to serve certain goals. But there are deeper laws that the totalitarian government has to protect, namely the laws of nature (in the case of Nazism, and more specifically the laws of natural selection) and the laws of history (in the case of communism, more specifically the laws that say that economic and industrial development will necessarily destroy capitalism and inaugurate communist production). Those “deeper” laws aren’t human laws; they are historical laws that drive mankind towards the realization of the project that animates totalitarianism. Totalitarian government serves to facilitate and fasten the operation of those deeper laws. Jews are exterminated because that promotes the ultimate and inevitable supremacy of Aryans. Capitalists, bourgeois, kulaks etc. are exterminated (or reeducated in order to become communists) because that promotes the ultimate and inevitable supremacy of the proletariat (the proletariat is doomed to rule given the evolution of capitalism, but its rule can be hastened).

There is no “regis voluntas suprema lex” as in previous forms of despotism. The legal lawlessness covers a deeper lawfulness. Legal laws have to be adapted to best serve the deeper laws. If terror and violence are required for the realization and hastening of the evolution postulated by the deeper laws, then the legal laws will mandate and require terror and violence. Terror and violence don’t only serve to intimidate, destroy opposition, isolate people from one another and coerce compliance. They serve the project of the people.

I think all this justifies grouping Nazi Germany, Soviet Russia and Mao-era China under a separate form of government. That doesn’t mean that everything about those regimes was new and typical only of totalitarian government. Obviously, genocides, terror, show trials etc. have occurred before and since. Those are not inventions of Hitler, Stalin or Mao. There are historical parallels, just as there are parallels between contemporary art and ancient art, but still we prefer to distinguish these two forms of art. We have to look beyond the phenomenology of despotic regimes throughout history, and identify the particular logic of different forms of despotism.

Cooperation and Excellence in Capitalism and Communism

An important and valuable aspect of work which has been lost in many activities is cooperation. The modern industrial production process is characterized by unconscious cooperation. The division of labor – within a factory or within the wider economy – is cooperation, but the workers in a factory or the baker and the butcher buying each other’s products, are unaware of it. The conscious cooperation of individuals producing something together is more valuable, educating and rewarding for the individuals than individual production or unconscious cooperation which, unfortunately, is the predominant type in capitalist production.

Cooperation also typically transcends the generations. It is important to build on the achievements of the past. So even when you can work alone in a meaningful way, for example as a craftsperson (which perhaps has become rather unlikely these days), you are not really alone because the past masters of the art are looking over your shoulder and guiding you. And maybe you have a pupil.

And here’s where another important aspect of work has to be rediscovered in our era of deskilled and atomized production: the standards of excellence. Absorbing the history and tradition of a practice makes us better persons and enables us to produce, be creative, express ourselves and develop our personalities. Without abilities taught to us by tradition this is impossible.

Excellence, as conscious cooperation, is often lacking in contemporary capitalist production. The atomization of workers resulting from the division of labor promotes ever more detailed and limited knowledge, rather than insight in and mastery over processes. Workers are also deskilled because of automation. Skill and knowledge are incorporated into machines and computers, and a worker is still, in many cases, a mere machine-appendix with no need to know how the machine works.

Communism has rightly accused capitalism of neglecting the need for conscious cooperation and excellence, but it has failed, even theoretically, to offer an alternative. The alternative for unconscious cooperation is real corporate democracy, something that is only hinted at in communist theory and not likely to follow from the simple abolition of private property. Likewise, the communist solution to the problem of excellence – the end of division of labor – isn’t satisfactory. Excellence or skill require education institutions and encouraging and supporting communities, which are often lacking or underperforming in industrial societies. The days of the atomized workers in anonymous industrial cities and extremely compartmented factories may be gone (in the West at least), but capitalism still isn’t known for its ability to foster supporting communities. And neither is communism. Only with supporting educational institutions and communities can individuals become someone, learn something and transform themselves through the activity of work.

It is obvious that corporate democracy is not enough to achieve this focus on excellence. And neither is the abolition of the division of labor. On the contrary. Excellence and skill require some modicum of division of labor. It is an illusion to believe in a future society where anyone can engage in or change into any activity he or she wishes, like Marx unfortunately did. This kind of variety and polyvalence is incompatible with excellence and skill. People are finite beings with limited time and abilities. One has to choose one’s “trade”, try to become skillful and hopefully lead a life of learning and growth, of productive and creative self-development and of self-expression within this “trade”. Some changes of heart are of course possible and desirable, but not limitless. But the word “trade” implies division of labor. Communism’s hope that automation would reduces the necessity for skills and trades is unrealistic and undesirable as well, given the benefits of excellence (i.e. education, community, belonging, support etc.). But this division between “trades” is rather different from the highly atomized world of divided labor in current industrial processes.

Excellence is not only incompatible with the complete abolition of division of labor. It also requires giving up the demand for total worker equality. The capitalist ideology of managerial expertise is groundless and oppressive. It reduces the workers to executors of the managers’ plans. It is obvious that the knowledge necessary to plan is not acquired through theoretical thinking but rather through working practice. So the division between workers and managers is artificial and will not hold.

But, on the other hand, complete worker equality will not hold either. Achieving standards of excellence leads, by definition, to differences between people, and it requires dependence (often temporary) on teachers, “masters” and tradition. One can see such a relationship as a form of domination to be combated, and it certainly is in many capitalist companies where it is often even undone of its original educational aspects. But it doesn’t have to be. It can be viewed as transformative for the “pupil”. Excellence leads to a good product and to a better producer as well, to someone who can become somebody and who expresses and develops his or her personality through production. This personal transformation through learning and production goes way beyond the transformation of skills. It touches the entire personality.

Why Do Countries Become/Remain Democracies? Or Don’t? (18): External Triggers

In the previous posts in this blog series, I only discussed internal reasons why a particular country moves towards or away from democracy. But of course, no country stands on its own, unaffected by what happens in the rest of the world. Democratization is hardly ever a purely domestic event or the sole result of internal democratic forces. There are and have been important external triggers, both helping and impeding the transition to democracy.

The fall of the Soviet Block in 1989 and the defeat of the Axis powers after WWII were global events that led to the overthrow of a whole series of authoritarian governments. On the other hand, the Cold War meant that authoritarian leaders everywhere in the world were buttressed or installed as a buffer against communism or capitalist imperialism (“he’s a son of a bitch, but he’s our son of a bitch“). Furthermore, the economic interests of powerful countries often convinced them and sometimes still convince them to support dictators in oil-rich countries (Saudi Arabia for instance). And besides oil there are other strategic interests that may make it “necessary” to support dictators in other countries (for example, concern for the security of Israel led the US to support Mubarak in Egypt).

Sometimes, powerful countries decide that they should use their military to directly intervene in a country and install democracy by force (Grenada may be an example, and people sure try hard in Afghanistan and Iraq and perhaps also in Libya). Another form of intervention intended to support democracy is conditional aid: wealthy countries or international institutions often tie aid to “good governance” requirements.

And a final external trigger for democracy development is the dominance of the West in the international entertainment industry. When people in authoritarian countries consume western entertainment, they learn to associate democracy with prosperity and freedom.

Of course, external triggers alone won’t produce an enduring democracy, and certainly not when those triggers don’t encourage domestic aspirations. For example, it’s futile to force a country to hold elections through the use of conditional aid or military intervention when the rule of law isn’t in place, when there’s sharp polarization between groups or when a democratic culture isn’t in place. Democracy depends on internal support. People have to believe in democracy and participate, and the institutional structure has to be in place. However, the appetite can come while eating: a certain amount of experience with democracy may be required for institutions and mentalities to grow. Hence, it’s just as futile to wait with external triggers until all the preconditions for democracy are in place.

Communism and Corporate Democracy

In an effort to convince you that my new $19.95 book is actually worth a lot more than that, I’m blogging some excerpts. Today, the importance of corporate democracy.

What can we learn from communism? I realize that, for many people, learning from communism is like listening to the devil. But that’s intellectual laziness, dismissing something without fully understanding it. So bear with me.

For example, our capitalist systems have shed many of the extreme injustices that characterized them in the time of Marx. But it’s still the case today that ownership of the means of production yields a kind of economic power over the workers who depend on the owners and who are forced to sell their labor power because they don’t have means of production of their own.

This dependence results in economic uncertainty and possibly poverty, because of the competition between workers trying to offer the best deal to employers. The fact that no modern economy has full employment makes this competition inevitable, even though today it’s more an international than a national competition. The “reserve army” now seems to be stationed abroad. International outsourcing (or the threat of it) pushes wages down.

We should also acknowledge that economic dependence in a system of private ownership of the means of production can be psychologically detrimental in the sense that it makes creative productive activity, self-expression and self-development (which require the free use of means of production) very difficult if not impossible. Moreover, it means that people are forced to work in systems based on discipline, supervision and control. Corporations have become islands of authoritarianism in a democratic world. If democracy and self-government are important in politics, why not in business?

Given the importance of work and production in the life of an individual and their potentially beneficial role in personal self-development, and given the importance of democracy and self-government, it is justified to give people a say in the way in which the means of production are used. The owners of the means of production should not be entitled to decide unilaterally on the conditions, organization, purposes, processes and meaning of production. Production is an important part of human life and people should have a say in it.

Concretely, this means a kind of corporate democracy and corporate participation. Participation, not by the shareholders (corporate democracy is today mostly viewed as a right of shareholders), but by the people directly involved in production, i.e. the “workers”.

Communism traditionally proposes the end of the employment relationship (or the right to rent people) and the common ownership of the means of production as the ways to achieve this participation and to abolish so-called alienation (which means working for a wage, or working in an obscure system of division of labor, rather than working for a product). The workers in the factory, rather than the capitalists or the shareholders, would own the factory and all the assets in common. Or, more correctly, society as a whole, which in communism means the class of workers, would own the totality of all means of production, because otherwise the workers would be tied to one specific means of production and wouldn’t be able to switch freely to another one.

This would obviously spell the end of private property, not necessarily private property as such, but in any case private property of the means of production.

This is unacceptable because private property is an important value. It’s unequal distribution should be criticized, as well as the exclusive right of decision of the owners of the means of production, but there are good reasons to keep the right to private property more or less intact.

Common ownership of the means of production, as proposed by traditional communists, is not the only means to create corporate participation and worker control over production. Communism should simply mean the community of workers in a factory or corporation deciding more or less democratically on their work. Modern-day capitalism has in some cases reconciled private ownership with large measures of worker participation. Many decisions in companies are now taken by the owners and the workers together. (This participation is not incompatible with the free market either. A free market is a system between economic agents, not within them). But we should try to go further and extend and deepen this participation in order to make production and work more meaningful.

Private property of the means of production should not be understood as an absolute right to govern the workplace dictatorially. And the abolition of private property is not a prerequisite for corporate democracy. This is evident if we take a look at historical cases of communist rule, where private property was abolished (to some extent) but corporate governance continued much along the same lines as in capitalism. The bosses changed – autocratic party members and government bureaucracy instead of capitalists – but the workers didn’t have more influence.

This proves that corporate democracy requires something more than or different from common ownership. Private ownership, strictly speaking, gives the employer only the right to label someone a trespasser.  So abolishing ownership will not, of itself, change how production takes place. Changes have to occur, not on the level of the ownership of the means of production, but on the level of the organization of production.

Marx, Substructure, Superstructure and Human Rights

The substructure, according to communism, is the mode of production or the nature of productive activity. Productive activity means the production, in interaction with nature, of goods necessary to survive. This production requires, on the one hand, means of production (materials, machines, land, tools, labor etc.) and, on the other hand, relations in which production takes place (relations of co-operation or ways of organization such as relations between masters and slaves, employers and employees, landowners and farmers etc.). The combination of means (or forces) of production and relations of production is the mode of production.

The available means of production determine the relations of production. A certain degree of development in the former necessarily produces a certain degree of development in the latter. This idea is the basis of the historical evolution of society that is so important in communism.

In production, men not only act on nature but also on one another. They produce only by co-operating in a certain way and mutually exchanging their activities. In order to produce, they enter into definite connections and relations with one another and only within these social connections and relations does their action on nature, does production, take place. These social relations into which the producers enter with one another, the conditions under which they exchange their activities and participate in the whole act of production, will naturally vary according to the character of the means of production. With the invention of a new instrument of warfare, firearms, the whole internal organization of the army necessarily changed: the relationships within which individuals can constitute an army and act as an army were transformed … Thus the social relations within which individuals produce, the social relations of production, change, are transformed, with the change and development of the material means of production, the productive forces. These social relations are therefore independent of the will of the participants. They depend on technology, the availability of land etc. Each major change in the relations of production and the organization of production, caused by changes in the means of production, leads to a major change in the type of society we live in.

The combination of means of production or productive forces on the one hand, and relations of production on the other, is the substructure and determines the superstructure or the collection of different forms of consciousness, such as law, morality, religion, philosophy, politics etc.

The substructure is “the real foundation, on which rises a legal and political superstructure and to which correspond definite forms of social consciousness”. “Economic production and the structure of society of every historical epoch necessarily arising therefrom constitute the foundation for the political and intellectual history of that epoch”.

Politics and law are parts of the superstructure which are determined by the substructure. They are formed by the interests of those who have economic power and they serve to defend these interests. “Political power … is merely the organized power of one class for oppressing another”. “Are economic relations regulated by legal conceptions or do not, on the contrary, legal relations arise from economic ones?” The quintessential example is the right to private property. Owners can use this right to defend their interests against the poor. They can appeal to the judiciary and the police force to defend their property and hence to maintain existing class relations and modes of production.

The right to private property makes it impossible for large groups of people to have their own means of production and hence to be economically independent and self-sufficient. In other words, it makes it impossible for people to be free.

However, the law is not only something that can be used to justify the use of force for the maintenance of the status quo. The use of force by the state for the defense of the right to property is not necessary when the poor can be convinced that this right is in their interest, that it is a human right rather than a right of the wealthy. The economic relationships and structures are maintained with political and legal force but also with legal ideology.

All ideologies are similar. Christianity can convince people to accept their situation by promising salvation in a future life, and the ideology of human rights does the same by convincing people, all people, that they have the same rights and that they are therefore equal. When this universality and equality of rights is accentuated, people do not see that others who have the same equal rights profit more from these rights. Human rights give the impression of guaranteeing freedom and equality but in reality give those who are better off tools to improve their situation even more, and at the expense of the poor. Instead of real equality there is only legal and formal equality, and the latter takes us further away from the former because the rich can use their equal rights to promote their interests. Rights give us the freedom to oppress rather than freedom from oppression.

Human rights, according to communism, are “an illusory sense of community serving as a screen for the real struggles waged by classes against each other”, an ideological veil on reality, a set of false ideas that has to cover up class rule and make it acceptable. The continuation of inequality by political and legal means is based on the combination of coercion and false consciousness. Christians are equal in heaven and thereby maintain inequality on earth, and believers in human rights are equal in the heaven of their political ideals and thereby forget the inequality that these ideals help to maintain. Again we see how the ruling class uses ideology rather than mere force to maintain its rule. It tries to instill certain beliefs in its victims and to use these beliefs as a drug, an opium to pacify them.

Like the protest inherent in the Christian ideology of a future paradise must be maintained but stripped of its ideological content, so the ideal of equality inherent in human rights must be maintained but in such a way that it becomes real equality in a real and worldly paradise, and not some kind of formal equality of rights that only aggravates real inequality and postpones paradise to the afterlife. The poor must become conscious of the fact that their formal equality only covers up their real inequality. This consciousness will be an important step in their liberation. However, as we will see later, this consciousness is conditioned by and can only come about at a certain time in the evolution of exploitation. It cannot result from education or political agitation alone.

The Compatibility of Freedom and Equality (10): Limited Freedom and the Temptation of the Future

It’s hardly controversial to claim that some limits on freedom are necessary in order to protect the freedom of others. Few people consistently argue in favor of an unlimited ability to do as one likes. More controversial is the internalization of this principle, in which it is possible and acceptable that a person’s current freedom is restricted in order to protect that same person’s future freedom.

I think this is only generally accepted when limited to children. A child loses some of its freedom when it is forced to attend school, do homework, learn good manners etc. because this will greatly improve his or her future opportunities and choices. A restriction of current freedom serves to expand future freedom. A child that isn’t forced in this way will find that he or she has fewer choices when grown up, and therefore less freedom.

But is this “less is more” philosophy of freedom, or the principle that one needs to be forced to be free (in the infamous words of Jean-Jacques Rousseau), also applicable to adults? Well, it does happen, whether it’s morally legitimate or not. Smoking bans, drug bans, helmet rules etc. are examples. Communism is also an example, although obviously a more extreme one. Citizens of communist states were often “encouraged” to suffer now for a better future and for the “reign of freedom”. There’s also a long tradition of anti-hedonism. A life focused on pleasure, desire and the avoidance of effort is frowned upon because of the damage it can do to the future self. Perhaps less today than in previous ages, but still… In all these examples, people take away other people’s freedom in the name of freedom. Limits on freedom are deemed necessary for the future enlargement of freedom. External discipline and control is put in place of lacking self-discipline and self-control, or external knowledge in place of lacking internal knowledge. If the objects of their coercion complain about it now, then perhaps later in life will they understand and appreciate the reasons why they were forced to do certain things.

This temptation of the future, as we can call it, is in fact an effort to equalize freedom: those who live a hedonistic life or who don’t understand their own long term interests run the risk of diminished freedom in the future. Other people will be tempted by a possible future freedom to try to restrict these people’s current freedom. Doing so, they believe, will give them access to equal freedom compared to those who do understand the demands of future freedom.

The problem here isn’t that the premise is stupid, but that the consequences of this premise can be harmful. Most people would readily agree that only a fully developed individual who doesn’t constantly yield to temptation and who invests effort in his or her life can have a wide spectrum of choice and hence freedom. Someone who forgoes effort is likely to become an uneducated bigot who has the freedom to choose between being a coach potato one minute and a nitwit the next.

But what gives other people the right to force this nitwit to make an effort and try to access a more interesting notion of freedom in the future? Even assuming that the use of force is effective in some objective and verifiable sense (that may be true of compulsory education for children, but not for other types of force directed at adults), are you morally allowed make people free by treating them as infants or idiots dependent on coercion and education? And, if so, is this freedom worth the disrespect that it entails? It’s clear that we’re rapidly turning the corner to some kind of fanatical altruism in which freedom is no longer the ability to do as you want but rather the ability to do as you should want.

Does this mean we shouldn’t ever force people for the sake of their future freedom? I don’t think so. There is room for some types of legal measures that protect obviously self-destructive people against themselves. Prohibition of hard drugs and of the free purchase and use of certain pharmaceuticals, as well as some measures regarding road safety are some examples of limitations that receive widespread approval, accept among hardcore libertarians. (Although most of them also go to the doctor when they are sick and obediently do as the doctor orders. They may say that this is their own free decision and therefore not comparable to legal prohibitions of strictly self-regarding behavior, but is this really their free choice? How many sick libertarians choose not to do what the doctor says?). We just have to be careful that we don’t go beyond a certain minimum (which I agree is difficult to determine) and don’t quietly slip into paternalism and the rule of the technocrats who think they know better how people should lead their lives.

Restrictions of freedom that aim to modify strictly self-regarding behavior must remain the exception for at least three reasons:

  1. It’s very difficult to prove that somebody does not understand his interest in the right way and that there is somebody else who has a better understanding of this interest.
  2. Even if 1 isn’t a problem, how are we going to select these “wiser” persons?
  3. And even if neither 1 nor 2 is a problem, how are we certain that our current restrictions have a positive net impact on future freedom? The future is, after all, hard to predict and past predictions that have been shown to be correct will not necessarily remain correct in the future.

Most of the time, people know very well what is or is not in their interest and how to maximize their future options and freedom by themselves. Democracy would be impossible or undesirable otherwise. Only if people know their own interests can they be given the power to decide for themselves and the power to control whether laws or policies are in their interest. Otherwise, guardianship or a paternalistic form of government would be more appropriate.

No matter how important it is to care and show compassion, we should not allow ourselves to get carried away by it. In general, we should allow people to decide for themselves, to determine their own way of life and their own interests, even if we believe that these people have chosen a wrong, inferior or offensive way of life and harm themselves as a consequence of the way in which they understand their interests (if they harm other people as well, then it is easier to intervene). Of course, we can advise people and try to convince them, but we should be very careful if we want to impose a way of life on people through the use of (legal) force, no matter how reasonable and beneficial this way of life seems to us. What is best for me is not necessarily best for everybody. Most people value the freedom to decide for themselves. The value of this freedom may even outweigh the value or price of any possible outcomes of their decisions.

Human beings owe to each other help to distinguish the better from the worse, and encouragement to choose the former and avoid the latter. They should be forever stimulating each other to increased exercise of their higher faculties and increased direction of their feelings and aims toward wise instead of foolish, elevating instead of degrading, objects and contemplations. But neither one person, nor any number of persons, is warranted in saying to another human creature of ripe years that he shall not do with his life for his own benefit what he chooses to do with it. He is the person most interested in his own well-being. John Stuart Mill

The Causes of Human Rights Violations (17): Private Interests and the General Interest

What kind of state do we desire? What kind of education for our children and for the children of the future? What kind of health care, not just for ourselves but for all citizens? How will we leave the environment for future generations? These questions and many others concern us all, no matter which private interests we have and which interest groups we belong to.

Unfortunately, it looks like the first objective of politics today is not to serve the general interest but to serve a variety of private interests expressed by pressure groups whose support the government must buy by way of special benefits, simply because it cannot retain its supporters when it refuses to give them something it has the power to give, in the words of Friedrich A. Hayek.

But not only governments and legislators are forced into this. Groups in society quickly understand that the best they can do is to play the game and try to win as many benefits as possible, otherwise they end up paying for the benefits of the rest of the population. We find ourselves in a vicious circle in which

  • politicians are forced to grant interest groups special benefits, simply because they can and because they would lose voters if they refused
  • interest groups are forced to ask for special benefits if they don’t want to end up as the only suckers paying for the benefits of others
  • different interest groups are out-asking each other because otherwise they end up paying more than they get
  • politicians are forced to give more because people ask more, but also have to tax more because the money has to come from somewhere
  • interest groups are forced to ask more to compensate for the heavier taxes
  • etc.

Of course, this is a libertarian dystopia which fortunately doesn’t quite work out the same way in reality. But it serves the purpose of highlighting the risks of interest group politics.

Given these risks, it’s unfortunate that politics in most democratic countries is so much focused on private interests. The majorities that do exist are not inspired by a general interest or by a common will to achieve something that will benefit society as a whole. They are no more than collections of different pressure groups which have all been promised benefits in exchange for their votes. These pressure groups can be certain states or provinces, whose representative will only vote for a proposal when he or she gets something in return which benefits the locals. Or they can be a certain profession, a religious group or whatever.

As a result, people do not see themselves as a community that can identify with the state and with politics. They only identify themselves with a particular interest group (or with several different interest groups, depending on the types of private interests that they want to see protected), and they see politics as an instrument to fulfill their interests or as a warehouse of advantages ready to be looted by whoever comes first.

This makes effective common actions and actions that serve the general interest very difficult if not impossible. Any vote on something that is of general interest – e.g. healthcare reform – can only pass if a series of private interests are satisfied at the same time. And again we have a vicious circle here. If the state cannot prove itself as a vehicle for common action and for the general interest, then people will not be encouraged to fall back on their private interests. Only successful common action can enable people to transcend fragmentation, to escape decomposition, to identify with the political community and to think of the state as something else than a loot. On the other hand, if the meaning of this political community is diluted, then it is very difficult to mobilize people for a common action, in the words of Charles Taylor.

This focus on private interests and sub-communities is completely different from the way in which the Ancient Greeks for example reflected on politics. In the Greek city states, the inhabitants of border regions were not allowed to participate in a vote concerning a declaration of war with neighboring countries. It was assumed that these inhabitants were unable to vote in accordance with the general interest. Their immediate private interest would inhibit a reasonable reflection on the general interest. In this case, some legitimate private interest where neglected. But today we seem to have gone from one extreme to the other.

Of course, there ‘s nothing wrong with self-interest as such. A conception of the general interest that is established without the cooperation of everybody or that is incompatible with the interests of a majority is likely to cause resistance. And also the interests of the minority are important. The basic interests of the minority are expressed in human rights which can’t be overridden by a democratic majority. We have to start from self-interest, but we do not have to end there. A general interest is always a reformulation of self-interest. And it’s this reformulation through political debate that is often missing, and politics tends to be  a mere sum of or a compromise between private interests.

However, the other extreme is also a risk. Exaggerating the importance of the general interest can be very dangerous as well. Those who have witnessed nazism or communism—or both—can testify to this. The general interest — whatever it is — can justify oppression because it can require the sacrifice of “small” private interests which hinder the development of the community, of the race etc.

Marx, Democracy and Human Rights, Ctd.

Some second thoughts after this and this. The system of private ownership of the means of production (factories, natural resources etc.) that characterizes the capitalist economies of all developed and many developing countries has proven to be very resilient and very successful economically speaking. Marxism and communism traditionally criticize this system, for many different reasons, the most important one being the alleged exploitation of the workers employed by the owners of these means of production.

However, in this blogpost, I want to focus on another, less well-known criticism. Marxism claims that the private ownership of the means of production yields not only an unfair share of economic power, but also of political power, especially when, as is more and more the case, the means of production also include information production (news, TV, movies etc.).

From the point of view of the defenders of democracy (such as we), that’s a highly relevant criticism, and its relevance hasn’t decreased during the century and a half since it was first expressed. It’s relatively uncontroversial to state that in all democracies the owners of the means of production influence democratic processes with

  • financial means (lobbying, campaign finances or outright corruption),
  • ideological means – as was already known to Marx
  • but also with information technology.

They use these means in order to further their own interests. Well-developed democracies have systems to detect and correct this (a free press for example) but these systems can themselves be “infected”.

Disparities in economic power tend to distort the democratic process. This process is based on the ideal of equal influence and the equal importance of everyone’s interests. But that’s an ideal. Existing democracy, as opposed to ideal democracy, often serves the interests of a particular part of the population (e.g. what marxism called “the ruling class”) rather than the interests of the people, in which case it is perverted or imperfect.

The purely formal abolition of the difference between rich and poor in a democracy – every citizen has one vote and as many rights as the next citizen – cannot hide the reality that some citizens can influence policies and public opinion much more than others and hence have more power. The difference is only abolished formally; in reality, democracy may serve to widen it given the fact that relatively powerful individuals or groups can use democracy to become even more powerful.

The communist theory that politics, including democratic politics, is a capitalist tool or that the state is a “capitalist machine”, has had an enormous success, even with people who are not communists or even anti-communists. Who is not convinced that the numerous military or covert interventions of the United States elsewhere in the world served the interests of American companies and American economic supremacy in general? Or that the elections in democracies are heavily biased by big business which wants politics to serve certain interests and therefore funds candidates, lobbies officials, indoctrinates the public through grossly biased television channels etc.?

The reason for this success is that the theory is based on reality. Politics is to some degree influenced by the economy and communism is still relevant to us today because it reminds us of this and because it was the first theory to systematically expose this. Also relevant and significant today is the theory that oppression is not only a power thing but is also based on ideology, persuasion, information etc.

What we have to reject is the communist insistence on determination. Politics and narratives are influenced but not completely determined by economics. According to communism, the superstructure of consciousness, religion, morality, politics and law is a mere product of the substructure of productive forces and class relations. However, we must accept that politics can be much more than violent oppression, ideological indoctrination or perversion of democracy for the purpose of maintaining class and property relations.

In a democracy especially, we see that politics can be a powerful tool for people to determine and control their common destinies and to expose and undo economic injustices. Consciousness and thinking are obviously much more than ideological shadows of the light of economic reality. (And religion is of course much more than opium for the people. It has many beneficial effects which we need not mention here. Even if it is a bag of illusions, which no one and not even Marx can prove, it is still a fact that religious illusions can have morally beneficial effects and can make life easier to bear. So why try to strip people of their illusions – which has proven very difficult anyway – for the sake of a better yet uncertain future?)

It is wrong to claim, as communism often does, that the economic perversion of democracy is a necessity. Communism sometimes acknowledges that improvements in the situation of the workers can be the product of democratic politics (no room to include citations here). However, these are mere footnotes in communist theory. In most cases, communism demands revolution and an entire change of system, based no longer on the private ownership of the means of production. Private ownership softened by economic and social human rights, social-democracy, legally enforced improvements for the workers etc. is not enough. It doesn’t have to be softened but replaced by the community of the means of production, or communism.

Communism therefore fails to acknowledge the importance of legality, and particularly of democratic participation in legislation and of the use of human rights (especially economic rights) to improve the situation of those who are worst of. Human rights are more than the right to private property. They include economic rights and the participation in democracy by workers’ representatives. The effective exercise of these rights can lead to some kind of redistribution of property, better working conditions, corporate participation and less poverty.

No matter how strong the influence, the economy and economic power do not completely determine politics and law. Human rights and democratic participation for example can and do change the economy. Human rights are more than purely formal, and certainly more than false consciousness, convincing the people that they are equal when they are not, and thereby deflating any pressure for change and maintaining the status quo. They can give power to those who want to change the economy. This is insufficiently acknowledged by communism. It is even likely that communism’s rejection of rights and democracy as bourgeois exploitation tools has facilitated human rights violations of totalitarian communist regimes.

The Ethics of Human Rights (5): China, Confucianism and Authoritarianism

Confucianism, the traditional Chinese ethical and philosophical system based on the teachings of Confucius (551 BCE – 479 BCE), is often blamed for the lack of freedom and the authoritarian and anti-democratic form of government in China. This post examines the merits of this attack.

Confucianism is not a religion, although many believe it is, perhaps because of its emphasis on morality and the extent to which it has shaped and become synonymous with the culture of much of East-Asia, including of course China but also Japan, Korea, Taiwan, Singapore, Vietnam and many other countries with large Chinese communities. It is rather a philosophy and a culture.

Although vigorously attacked by the Chinese communists, it is beyond doubt that Confucianism still remains a strong force in Chinese thinking.

Arguments against the link between Confucianism and authoritarianism

Confucianism does not have to lead to authoritarianism. Indeed, Confucianism places more value on internalized morality than on external repression of deviant behavior:

Confucius argues that under law, external authorities administer punishments after illegal actions, so people generally behave well without understanding reasons why they should; whereas with ritual, patterns of behavior are internalized and exert their influence before actions are taken, so people behave properly because they fear shame and want to avoid losing face. (source)

The exercise of rituals or rites (not in the religious sense but in the sense of everyday ritual actions or routines) teaches people to internalize norms and respect them voluntarily, not because of fear of punishment. Formalized behavior through rituals becomes progressively internalized. Laws and governmental power are relatively unimportant to Confucianism.

Another reason why Confucianism is not necessarily autocratic is the teaching that the king’s personal virtue spreads a beneficial influence throughout the kingdom. With a virtuous king, the need for the use of force is limited.

Arguments in favor of the link between Confucianism and authoritarianism

Rituals are not only used to internalize morality and to instill a sense of propriety or politeness, but also to assign everyone a place in society, a kind of relationship to others and a form of behavior towards others.

While juniors are considered in Confucianism to owe strong duties of reverence and service to their seniors, seniors also have duties of benevolence and concern toward juniors. (source)

This leads to a strict hierarchy in society, which is opposed to equal rights, universality of rights and the equal influence that is found in a true democracy.

Social harmony is the ideal that results from every individual knowing his place in society, assuming his role and responsibilities towards others and establishing the right kinds of relationships and forms of behavior. However, this social harmony is clearly opposed to adversarial democratic politics.

There is government, when the prince is prince, and the minister is minister; when the father is father, and the son is son. (Confucius, Analects XII, 11).

There can be no objection to filial duties and filial piety. But the duty of benevolence and concern of the older towards the younger, and the extension of this duty to the rulers with regard to the people, can lead to paternalism and an infringement of the right to chose one’s own style of life.

Confucianism sees a moral role of government, and a responsibility of the government for the physical and moral well-being of the people. Filial piety is extended within Confucianism to political loyalty of the subjects of a state or even outright submission to authority. This leads to political inequality and elitism which is hard to reconcile with democracy.

However, the original teachings of Confucius forced the subjects to obey only as long as the rulers showed moral rectitude and responsibility for the well-being of the people. When the rulers assume their duties, strict obedience is required. But when they fail, the people can rebel. So no “might is right” or absolute power. Later rulers of course interpreted Confucianism in a more authoritarian way, for their own benefit.

Other aspects of Confucianism, such as the priority of the state and the community over the individual, meritocracy etc. make it hard for a democratic culture of freedom to take root.

Incompatibility of Confucianism and democracy, human rights and freedom?

Democracy, rights and freedom are not the exclusive product of the West and they are compatible with all cultures and religions. However, all cultures and religions also contain elements that inhibit the development of freedom. But it is possible tochange these elements.

Other causes of authoritarianism

One should also be careful not to overstate the importance of culture. First of all, culture is often used by rulers to justify themselves, and in doing so they tend to distort the real meaning of the culture in question. As is evident from the examples above, many elements of Confucianism cannot justify authoritarianism. Secondly, authoritarianism has other, non-cultural causes. In the case of China: the legacy of communism, the priority accorded to the economy (a priority that is supposed to warrant human rights violations) etc.

Plato, Democracy, and “Human Rights” (3): Violence

The philosophers are the only ones who know the value and superiority of theoretical life. The rest will only appreciate their efforts once they are successful. This is an effort on the part of Plato to justify the use of force. Ordinary people will not strive autonomously or voluntarily towards a theoretical life because they do not understand the value of such a life. They will have to be forced (e.g. educated, moderated etc.). An emotional and materialist way of life must be prohibited. The leaders must not follow the desires of the people – as they do in a democracy – but on the contrary suppress these desires.

People have to be coerced. They must be taught the value of theoretical life. Their intellect must be stimulated, and their passions moderated. Censorship is therefore important. Art which stimulates the passions and desires must be prohibited. Art must be rational instead of emotional. Plato did not appreciate the art and mythology of his time, because they depicted the gods with the same shortcomings as man. Art must give the right example (Christianity and communism later followed in Plato’s footsteps).

However, Plato wanted to avoid physical force. He believes that truth is better than force and also better than persuasion based on opinions and argumentation. Self-evident truth forces the mind to accept it, but this force is quite different from physical force and it is more persuasive than opinions based on arguments.

The question is whether physical force can always be avoided. First, though, Plato wants to try the transmission of truth by way of education. He even proposed to take away the children from their families in order to insulate them from the bad habits of the ordinary people. A kind of tabula rasa. The purpose of education is to mold people according to the image or the model of the philosopher, to make a new man. If it is impossible to have a tabula rasa by means of forced adoption, then the old habits must first be taught away before new habits can be imprinted.

However, this is already a very violent form of education. Moreover, not everybody is adequate material for the fabrication of a philosopher. What happens with those people who turn out to be somewhat different from the plan? The best that can happen to them is hard discipline; the worst is elimination. They may be a bad example to the rest. Elimination either directly or through eugenics and arranged marriages.

The Platonic ideal is a society of people who lead a thinking life, who know the eternal truths and disregard the changing appearances, the desires of the body and the cycles of natural necessity. But it is not democratic to force one vision of the good life on all citizens. In a democracy, people must be free to choose their own good life. If we force them to lead a particular kind of life we enslave them, even if we think that it is for their own good and that later they will thank us for it.

And after we enslave them, we run into the problem of those people who are not able to live up to the model. Plato believes that the power of thinking can overcome the body and that this power can be developed and trained. Every human being has the power of thinking and the capacity to develop this power in such a way that it is correctly balanced with other powers such as emotions, ambitions etc.

But Plato admits that this training and discipline may sometimes be unsuccessful. The mind may not be able to gain a position of superiority with regard to other, more bodily faculties and desires. Some people will never be strong enough to fight the beast in them, not even with extreme discipline in a dictatorial state led by philosophers with an iron hand. The one who, in the eyes of Plato, was the best master of the beast in himself and hence the example to us all, was Socrates. By refusing to escape after having been condemned to death, he showed the undisciplined democrats how to live beyond desire, the ultimate desire being the wish to live.

What is Democracy? (25): Corporate Democracy

Given the importance of work and production in the life of individuals, it is justified to give them some say in the way in which the means of production are used. The owners of the means of production should not be entitled to decide unilaterally on the conditions, organization, purposes, processes and meaning of production. Production is an important part of human life and people should have a say in it.

Concretely, this means a kind of corporate democracy and participation. Communism traditionally proposes common ownership of the means of production. The workers in the factory, rather than the capitalists or the shareholders, would own the factory in common. Or, rather, society as a whole, which in communism means the class of workers, would own the totality of all means of production. This would obviously spell the end of private property, not necessarily private property as such, but in any case private property of the means of production.

This is unacceptable because private property is an important value. It’s unequal distribution should be criticized, as well as the exclusive right of decision of the owners of the means of production, but there are good reasons to keep the right to private property more or less intact (or, more specifically, the right to legal protection of private property and the right to use it freely).

Common ownership of the means of production, as proposed by traditional communists, is not the only means to create corporate participation and worker control over production. Modern-day capitalism has in some cases reconciled private ownership with large measures of worker participation. Many decisions in companies are now taken by the owners and the workers together. This participation is not incompatible with the free market either. A free market is a system between economic agents, not within them.

Marx and Human Rights

According to Marx, human rights are the “rights of the egoistic man, separated from his fellow men and from the community”. They are the rights of man as an isolated, inward looking, self-centered creature

  • who regards his free opinion as his intellectual private property instead of a part of communication
  • who uses his right to private property not in order to create a beach-head for his public and cultural life but to accumulate unnecessary wealth and to protect unequal property relationships
  • who uses the right to privacy as a wall keeping out the poor snoopers watching the rich people
  • who considers fellow men as the only legitimate restraint on his own freedom, and therefore as a limit instead of the source of his own thinking, identity and humanity (this is the way in which Marx read art. 6 of the French constitution of 1793: “Liberty is the power which man has to do everything which does not harm the rights of others”)
  • who considers freedom to be no more than the ability to pursue selfish interests and to enjoy property, unhindered by the need to help other people, “without regard for other men and independently of society”
  • and who considers equality to be the equal right to this kind of freedom (everybody can emancipate himself by becoming a bourgeois).

Human rights, in this view, serve only to protect egoism and the unequal distribution of property, and to oppress the poor who question this and who try to redistribute property. On top of that, human rights obscure this fact because they are formulated in such a way that it seems that everybody profits from them. Contrary to what is implicit in their name, “human” rights are not general or universal rights. They are the rights of those who have property and who want to keep it. A specific situation of a specific group of people is generalized in human rights.

Of course, this criticism can be correct. No one will deny that human rights can serve to protect and justify egoism, oppression of the poor and indifference. They can help to shield people behind private interest and to transform society into a collection of loose, self-centered, self-sufficient, withdrawn, independent, sovereign and isolated individuals. Because the rich have more means to use, for example, their freedom of expression, this freedom can be an instrument of the rich to monopolize political propaganda and political power and to use this power to maintain their privileged situation. Economic relationships can be maintained by legal means.

However, in order to judge and possibly reject a phenomenon, one should also look at its intended and ideal functions, not only at the ways in which it can be abused. Human rights not only protect man against the attacks and claims of other people (for example the attacks and claims on his property); they also create the possibility of forcing people to help each other. They do not allow you to do something to other people (taking their property, determining their opinions etc.), but at the same time they invite you to do something with other people. In other words, they are not only negative. They not only limit the way we relate to other people, they also stimulate and protect the way we relate to other people.

Why Do We Need Human Rights? (5): Property Rights

Private property often does not have a good press. It’s unequal distribution has often been criticized. However, there is a recognized human right to private property (or, more specifically, the right to legal protection of private property and the right to use it freely) and this right is important for different reasons.

First of all, private property is a means to protect of the private space. Without private property, without your own house or your own place in the world, and without your own intimate and personal things, it is obviously more difficult to have a private life. The four walls of your private house protect you against the public.

Without private property, there is no private world (another example of the indivisibility and interdependence of human rights).

Just as there is no light without darkness, there is nothing common to all people and no public space without private property. So private property protects publicity, commonality etc. Independence, self-reliance, autonomy, and therefore, also freedom, are important values, and these values rely heavily on private property.

Private property is also important for the creation and maintenance of relationships. You have your own house and your own place in the world, but not in the world in general. You live in a particular world, in a very concrete social context of friends, enemies, neighbors and other types of relationships. A place in the world is always a place in a particular community, even if you have to transcend this community now and again.

Furthermore, property is an important tool in the creative design of your personality, especially, but not exclusively, when you are an artist.

Finally, it is obvious that without private property there can be no help or generosity. Generosity and the absence of egoism are important for the preservation of a community.

The right to private property, and in particular, the right to your own house, is linked to the freedom to choose a residence, which again is linked to the freedom of movement (again another example of the indivisibility of human rights).

The right to private property is, just as most of the other human rights, a limited right. There can and should be redistribution of private property from the rich to the poor, if other human rights of the poor suffer as a consequence of insufficient private property (for example, the economic rights of the poor). Taxation and expropriation, however, should be used carefully, in view of the numerous important functions of private property. The more property a state acquires, the weaker the citizen becomes. Weaker not only compared to the state, but also compared to fellow citizens. His fellow citizens will find themselves in a position whereby they can control and intervene in his weakened private space.

You also own your own body. Your body is part of your private property. It is something that is yours; it is the thing par excellence that is your own. It is not common to several people and it cannot be given away. It cannot even be shared or communicated. It is the most private thing there is. Owning your body means that you are the master of it. Other people have no say in the use of your body; they should not use it, hurt it or force you to use it in a certain way. This underpins the security rights such as the right to life, the right to bodily integrity, and the prohibition of torture and slavery. It also implies the right to self-determination, and therefore, the right to die. You carry prime responsibility over your own body and life.

The property of your body can justify private property of material goods. The power of your body and your labor is incorporated in the goods you produce. By working on an object, you mix your labor with the object. If someone wants to take this object away from you, he also takes away your labour, which means that he takes away the power of your body. He therefore uses your body, which is incompatible with your right to possess your own body. See John Locke for a more elaborate exposition of this argument. If man owns his body, he also owns the power of his body and the objects in which this power is incorporated, to the extent that he has not stolen the objects. This can also be used as an argument in favor of some form of communism.

The right not to be a slave is the negative version of the right to possess your own body. Those who commit slavery (but also those who steal) act as if the bodies of other people are their property, a property that can be bought and sold. Considering other people as your property diminishes the value and dignity of these other people. Other people should not be considered as a means.

What Are Human Rights? (4): Not Given Rights

A right is not what someone gives you; it’s what no one can take from you. Ramsey Clark

Although the state plays an important part in enforcing rights, these rights are not given by the state. They exist prior to the state and hence are not a gift, a reward, or a favor granted by the state to its citizens, possibly in exchange for something else, for example obedience or the entry into a certain social class. Rights are not part of a contractual relationship.

The states of the Soviet block were notorious for this kind of reasoning. They considered rights to be a favor given by the state to exemplary citizens, to citizens who had proven to be particularly useful in the advance of communism. These citizens did not have rights but privileges, and rights were not the primary or sole objective of the state. Communist states also viewed rights in a purely functional way. Exercising human rights was only possible if this was of any use to the progress of communism. Consequently, it was impossible to enforce human rights. The state decided when and where they could be enjoyed, and when and where it could violate them.

Human rights, however, are unconditional. People have human rights because they are human beings. No other conditions are necessary.
